TERMS AND WARRANTY

SHIPPING INFORMATION

Shipments are sent U.P.S., Federal Express, or best way. Overseas shipments are sent Air Express International or by customer's preference. All shipments are F.O.B. Solana Beach, California, and are prepaid and added to the customer's invoice. Should damage occur during shipment, please adviseC.B.S. SCIENTIFICCOMPANY by phone or fax immediately. INTERNATIONAL SHIPPING CHARGES--please contact Customer Service.

PAYMENT TERMS

Payment terms are net 30 days. With an established credit account, orders may be placed using a purchase order number. We also accept Visa, Mastercard, Discover and American Express credit cards. Overseas orders must be prepaid before shipment. All orders are subject to acceptance byC.B.S. SCIENTIFICand to equipment availability. Delivery dates are estimates andC.B.S. SCIENTIFICshall have no liability for delays.

RETURNS

Products may only be returned toC.B.S. SCIENTIFICat our option, with prior authorization. A restocking charge of 25% of the selling price will be applied to all shipments returned for exchanges or credit. All requests for adjustment must be made 30 days from date of invoice. All returns are subject to the terms stated on the return authorization form.

WARRANTY

C.B.S. SCIENTIFIC warrants that its equipment shall conform to the specifications inC.B.S. SCIENTIFIC's literature. Should any equipment fail to conform to its specifications,C.B.S. SCIENTIFICmay, at its option, choose to replace it free of charge or refund the purchase price.

C.B.S. SCIENTIFIC 's equipment is warranted, to the original purchaser, against defect of manufacture, under normal usage, for a period of three years from the date of shipment. Third party equipment distributed byC.B.S. SCIENTIFICis covered only by gthe warranty provided by the original manufacturer.C.B.S. SCIENTIFIC's warranty policy is the customer's exclusive remedy for any defects or deficiencies in the equipment and forC.B.S. SCIENTIFIC's performance.

THERE ARE NO EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.

If equipment is found to be defective within the warranty period, authorization for return should be obtained fromC.B.S. SCIENTIFICcutstomer service. After receiving authorization, repair services may be initiated or the unit returned at the Purchaser's expense. This warranty excludes all costs of shipping, customs clearance and related charges outside the continental United States and Canada.C.B.S. SCIENTIFIC's sole liability and Purchaser's exclusive remedy for a breach of this warranty is limited to repair, replacement or refund at the sole option ofC.B.S. SCIENTIFIC. This warranty does not apply if the product (1) is altered, modified, damaged or repaired by someone other thanC.B.S. SCIENTIFIC; (2) is damaged due to use contrary to any instruction manual furnished byC.B.S. SCIENTIFIC; (3) is damaged due to the use of equipment not manufactured, supplied, or approved byC.B.S. SCIENTIFIC; or (4) is otherwise abused, misused or subjected to an accident. Additionally, the warranty is not transferable or available to any other consumer or user subsequent to the initial Purchaser.

C.B.S. SCIENTIFIC SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, EVEN IF IT IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES.C.B.S. SCIENTIFIC'S TOTAL LIABILITY FOR ANY ORDER SHALL NOT EXCEED THE AMOUNTS PAID BY THE CUSTOMER UNDER SUCH ORDER.

TERMS AND CONDITIONS

The terms and conditions in this catalog constitute the entire agreement between the parties with respect to the equipment purchased hereunder. Any additional, different or inconsistent terms and conditions in a purchase order form or like forms used by customer to purchase, change, accept or otherwise process the orders are objected to and are not binding onC.B.S. SCIENTIFIC.

This agreement between the parties shall be governed by the laws of the State of California without regard to its conflicts of laws rules. It is agreed that all disputes arising out of or related to the agreement shall be resolved solely in the U.S. District Court for the Southern District of California or in the state courts in San Diego County, California.

DISCLAIMER

We make no statement as to guaranteed effectiveness of acrylic radiation shields, and we highly recommend that the "e;safety level"e; of beta radiation to be used with these shields be determined by each laboratory's radiation safety officer.
